1. About these terms
These terms of service ("Terms") are a contract between you and Ghost Dinners Group Limited, trading as GhostScreen ("GhostScreen", "we", "us"), company number 16547834, registered office 3 Colndale Road, Colnbrook, Slough SL3 0HQ, United Kingdom.
They apply to ghostscreens.com, the GhostScreen dashboard and the GhostScreen app (the "Service"). By creating an account or using the Service you agree to these Terms on behalf of yourself and the business you represent ("you").
The Service is for business use only. You must be at least 18 and authorised to bind your business.
2. Your account
- Give us accurate information and keep it up to date.
- Keep your login details secure. You're responsible for activity on your account.
- Tell us straight away at support@ghostscreens.com if you think your account has been misused.
3. Plans, fees and payment
- Display is charged per screen per month. Intelligence is charged per location per month, with screens included as described on our pricing page.
- Fees are billed monthly in advance in pounds sterling and exclude VAT, which we add where applicable.
- You authorise us and our payment processor to charge your payment method each month until you cancel.
- If a payment fails, we'll let you know and may suspend the Service until it's paid.
- We may change our prices with at least 30 days' notice by email. Changes apply from your next billing date after the notice period.
4. Free trials
Where we offer a free trial, you'll need to add a payment method at sign-up. Unless you cancel before the trial ends, your paid plan starts automatically and you'll be charged. We'll remind you by email before the first charge. One trial per business.
5. Changes and cancellation
- You can add or remove screens, change plans or cancel at any time from your dashboard.
- Plans are monthly rolling with no minimum term. If you cancel, the Service continues until the end of your current billing period and isn't renewed.
- Fees already paid aren't refundable, except where the law requires or we say otherwise.
- Increases to your plan take effect immediately and are charged pro rata. Decreases take effect from your next billing date.
6. Acceptable use
You agree not to use the Service to:
- display anything unlawful, misleading, defamatory, obscene or that infringes anyone's rights;
- break any law, including consumer protection, pricing and allergen labelling rules;
- interfere with, reverse engineer or try to gain unauthorised access to the Service;
- resell or provide the Service to others without our written agreement.
We may remove content or suspend accounts that break these rules.
7. Your content
You keep ownership of the menus, prices, images and other content you upload ("Your Content"). You give us a licence to host, copy and display Your Content only as needed to provide the Service.
You're responsible for Your Content, including that prices, descriptions and allergen information shown on your screens are accurate and lawful.
8. Till integrations
If you connect a third-party till system, your use of it is governed by that provider's terms. We aren't responsible for their service, and we can't guarantee updates if their system is unavailable or changes how it works.
9. Our intellectual property
The Service, including our software, templates, designs and brand, belongs to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use it for your business while your account is active. Feedback you send us may be used without obligation to you.
10. Privacy and data
Our privacy policy explains how we handle personal data. Where we process personal data on your behalf, our Data Processing Addendum forms part of these Terms.
11. Availability and support
We aim to keep the Service running at all times but don't guarantee it will be uninterrupted or error-free. We may carry out maintenance and will try to give notice of planned downtime. Screens keep showing your last saved boards if they lose connection.
We may improve or change features over time. If we remove a feature that's central to your plan, we'll give you reasonable notice.
12. Hardware and TVs
Our compatibility checker is a guide. We can't guarantee every TV model will work. If you buy hardware through us, separate terms and the manufacturer's warranty apply.
13. Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or anything that can't be limited by law.
Otherwise, we aren't liable for loss of profits, revenue, business, goodwill or data, or any indirect or consequential loss. Our total liability in any 12-month period is limited to the fees you paid us in that period.
The Service is provided "as is" to the extent permitted by law.
14. Indemnity
You agree to cover our reasonable losses and costs from any claim arising from Your Content or your breach of these Terms.
15. Suspension and termination
We may suspend or close your account if you seriously or repeatedly break these Terms, don't pay, or if the law requires it. Where reasonable, we'll give notice first. When your account closes, your right to use the Service ends and we'll delete Your Content as set out in our privacy policy. You can export it before then.
16. Changes to these terms
We may update these Terms. For significant changes we'll email you at least 30 days before they take effect. If you keep using the Service after that, the new Terms apply. If you don't agree, you can cancel before they take effect.
17. General
- These Terms, together with any order and the documents they refer to, are the entire agreement between us.
- You can't transfer these Terms without our consent. We may transfer them to a company that takes over our business.
- If any part is found unenforceable, the rest still applies. Not enforcing a right straight away doesn't waive it.
- Neither of us is liable for delays caused by events beyond our reasonable control.
- No one else has rights under these Terms under the Contracts (Rights of Third Parties) Act 1999.
18. Governing law
These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
